Emergency Prescription Refill in Florida Hurricane Season

By Prime Health Consultants · Last updated October 30, 2026 · 7 min read

Quick answer

Under Florida Statutes section 252.358, health insurers and HMOs regulated in Florida must waive refill time limits and pay pharmacies for at least a 30-day supply when you live in a county under a hurricane warning, a state of emergency, or an activated emergency operations center. You must still have authorized refills left, and your other policy terms still apply. Plans that are self-funded by an employer are generally regulated under federal law instead and may not follow this rule, so call the number on your card to confirm how your plan handles early refills.

What does Florida law say about early prescription refills before a hurricane?

Florida has a specific rule for this. Section 252.358 of the Florida Statutes covers emergency preparedness prescription refills. It applies to health insurers, managed care organizations, and other entities licensed by the Florida Office of Insurance Regulation that provide prescription drug coverage.

When the rule is active, those insurers must waive their normal refill time limits. That includes turning off the electronic "refill too soon" checks at the pharmacy, as long as you still have authorized refills left on the prescription. They must also pay the pharmacy for at least a 30-day supply of any prescription medication, no matter when it was last filled.

The law does not remove the rest of your policy. Your copay, your formulary (the list of drugs your plan covers), and other policy terms still apply. It also does not create new refills if your prescription has none left.

When does the early refill rule turn on, and how long does it last?

The rule is tied to where you live. You must reside in a county that meets at least one of the conditions below. Your county's situation matters, not the state as a whole.

You must ask for the refill within 30 days after those conditions begin, or until the conditions end or no longer exist. The Office of Insurance Regulation can extend the waiver period in 15-day or 30-day steps by issuing an emergency order.

Conditions that trigger the rule under section 252.358 (your county only needs one)
Condition in your countyWho issues itHow long you can ask for a refill
Hurricane warningNational Weather ServiceWithin 30 days after it begins, or until it ends
State of emergencyGovernor, by executive orderWithin 30 days after it begins, or until it ends
Emergency operations center and emergency management plan activatedThe countyWithin 30 days after it begins, or until it ends
Extension of the waiverOffice of Insurance Regulation, by emergency orderIn 15-day or 30-day increments

What if I cannot reach my doctor and I am running out?

A separate Florida law speaks to pharmacists. Under section 465.0275, if a pharmacist gets a refill request and cannot readily get authorization from your prescriber, the pharmacist may dispense a one-time emergency refill of up to a 72-hour supply. For insulin, insulin-related supplies, and equipment used to treat diabetes, a pharmacist may do an emergency refill up to three nonconsecutive times per calendar year.

If the Governor issues an emergency order or declares a state of emergency, a pharmacist may dispense up to a 30-day supply in the affected areas. This is allowed only if the drug is not a Schedule II controlled substance, the medicine is essential to maintaining life or continuing therapy for a chronic condition, and the pharmacist judges that stopping could reasonably cause undesirable health consequences or physical or mental discomfort.

These rules say what a pharmacist is allowed to do. They do not say your plan will pay. Ask the pharmacy up front whether it can bill your plan, and what you would owe if it cannot.

Whose plan is not covered by the Florida rule?

Section 252.358 binds insurers and other entities licensed by the Florida Office of Insurance Regulation. Some coverage works differently, so do not assume the rule applies to you.

Many employers fund their own health plan instead of buying insurance. These are called self-funded plans. They are generally regulated under federal law (ERISA) rather than Florida insurance law, so Florida's early refill rule may not bind them. Florida's consumer services division says on its own site that it does not handle certain self-funded large employer plans and refers those people to the U.S. Department of Labor. If you have a self-funded plan, ask it directly what it does about early refills.

Plans without prescription drug coverage have nothing to refill early, and some plan types, such as short-term or fixed indemnity plans, may work differently. Government and church plans can follow other rules too. Check your plan documents, or ask your employer's benefits contact whether your plan is insured or self-funded.

What should I do to prepare my health coverage for a storm?

Your coverage details deserve a place on the hurricane list. Do these steps before a storm is close, while phones and internet still work.

  • Take clear photos of the front and back of every insurance card, and of your pharmacy discount or benefit cards. Save them to your phone and to a cloud folder.
  • Write down the member services phone number from each card, plus the number for your pharmacy and each doctor.
  • Make a list of every medicine: name, dose, how often, the pharmacy, and the prescriber's name. Include supplements and any medical supplies, like test strips.
  • Check how many refills you have left on each prescription. Ask your doctor's office for new prescriptions now if you are close to zero.
  • Ask your plan whether it offers telehealth visits, and write down how to start one. Telehealth needs a working phone or internet connection, so do not count on it alone.
  • Put copies of your cards, medicine list, and key phone numbers in a waterproof bag with your other important papers.

What if I evacuate, and how do I keep records for reimbursement?

If you leave the area, you may need care in a city your plan does not usually serve. How that is covered depends on your plan and its network. Emergency care and routine care can be treated differently, and care outside the network can cost more or may not be covered. The plan documents and the member services line are where you get a real answer, so ask before you leave if you can.

Keep every receipt and every piece of paper. If you pay out of pocket for a prescription, an urgent care visit, or a replacement item like a medical device, ask the provider for an itemized receipt. Take photos of it and write down the date, place, and who treated you. Later you can ask your plan whether the cost can be reimbursed, and the receipt is your proof if it can.

When you get back, check your Explanation of Benefits (the statement your plan sends after a claim) against what you actually received. If something looks wrong, you can appeal. A licensed advisor at Prime Health Consultants can explain the claims and appeals process and guide you when needed.

When does it make sense to talk to a licensed advisor?

If you are not sure whether your plan is insured or self-funded, or you have changed plans recently and do not know what the new one does with refills and out-of-area care, a short conversation can clear it up. Prime Health Consultants advisors are licensed and can explain your options in English and Spanish.

You do not need to wait for a storm. Calm weather is the easier time to read plan documents.

Common questions

Can I refill my prescription early before a hurricane in Florida?

Often yes, if you have authorized refills left and your county meets a trigger in section 252.358: a hurricane warning, a Governor's state of emergency, or an activated emergency operations center. Florida-regulated insurers must then waive refill time limits. Plans that are self-funded by an employer may not be bound by Florida law, so confirm with your plan.

How much medication can I get during an emergency?

Section 252.358 requires insurers to pay pharmacies for at least a 30-day supply. Separately, under section 465.0275, a pharmacist may dispense up to a 30-day supply when the Governor declares an emergency, if specific conditions are met, and a 72-hour emergency refill when the prescriber cannot be reached.

Does the early refill rule apply to controlled substances?

Section 252.358 does not single out controlled substances. A pharmacist's emergency 30-day dispensing under section 465.0275 does exclude Schedule II controlled substances. Pharmacies also have their own rules, so ask your pharmacist and your prescriber.

My employer-sponsored plan says it is self-funded. Does the Florida law apply?

Self-funded employer plans are generally regulated under federal law (ERISA) instead of Florida insurance law, so section 252.358 may not apply. Ask your employer's benefits contact or your plan's member services whether it offers early refills during a declared emergency.

What if I evacuate to another state?

Coverage for care away from home depends on your plan and its network. Call the member services number on your card before you go if you can, ask about emergency and routine care, and keep itemized receipts for anything you pay yourself.
